End User License Agreement

1. Agreement to Terms

This End User License Agreement ("EULA") is a legal agreement between you and ZDTech Group Ltd ("Company," "we," "us," or "our"), a company registered in the United Kingdom, for the Mapplicant mobile application ("Application" or "App"). By downloading, installing, or using the Application from the Apple App Store or Google Play Store, you agree to be bound by this EULA. If you do not agree to these terms, do not download, install, or use the Application.

2. License Grant

Subject to your compliance with this EULA and our Terms & Conditions, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use the Application on your personal mobile device(s) running iOS or Android
• Access and use the Application solely for your personal or internal business purposes related to job search or recruitment
• Receive updates and new versions of the Application as we make them available

3. License Restrictions

You shall not:

• Copy, modify, adapt, translate, or create derivative works of the Application
• Reverse engineer, decompile, disassemble, or attempt to discover the source code of the Application
• Distribute, sublicense, rent, lease, lend, or sell the Application to third parties
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices from the Application
• Use the Application for any illegal, unauthorized, or fraudulent purpose
• Interfere with or disrupt the Application, servers, or networks connected to the Application
• Use any automated systems, bots, or scrapers to access the Application
• Circumvent any security features or access restrictions of the Application
• Upload or transmit viruses, malware, or other malicious code

4. Intellectual Property Rights

The Application and all rights, title, and interest therein, including all intellectual property rights, are and shall remain the exclusive property of ZDTech Group Ltd. This includes but is not limited to:

• Software code, algorithms, and architecture
• User interface design and graphics
• Trademarks, service marks, and logos ("Mapplicant" and related marks)
• Documentation and help materials
• All updates, modifications, and enhancements

This EULA does not grant you any ownership rights or licenses to our intellectual property beyond the limited use license specified herein.

5. User Content and License

You retain ownership of any content you submit through the Application ("User Content"), including your CV, profile information, job postings, and messages. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, display, and distribute such content solely for the purposes of:

• Operating and providing the Application and its features
• Displaying your profile to employers (when you apply or subscribe to Pro Seeker)
• Displaying job postings on the map and to relevant users
• Improving and developing our services
• Complying with legal obligations

6. Subscriptions and In-App Purchases

6.1 Subscription Plans

The Application offers the following paid subscription plans as in-app purchases:

• Pro Seeker: £4.99 per month - Enhanced features for job seekers including premium avatars, phone number display, CV upload, and special map pin color
• Business Pro: £19.99 per month - Business features including manual job posting, application management, candidate shortlisting, and direct candidate contact

6.2 Payment and Billing

All subscriptions are purchased through and managed by the Apple App Store or Google Play Store. Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. We do not directly process or store your payment information. All payment transactions are subject to the terms and conditions of the App Store or Google Play Store.

6.3 Auto-Renewal

Subscriptions automatically renew each month unless auto-renewal is turned off at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period. If a renewal payment fails, you have a 3-day grace period to update your payment method. During this grace period, you retain access to subscription features. If payment is not received within 3 days, your subscription will be cancelled.

6.4 Managing Subscriptions

You can manage your subscriptions and turn off auto-renewal through your device settings:

• iOS: Settings > [Your Name] > Subscriptions
• Android: Google Play Store > Menu > Subscriptions

6.5 Cancellation and Refunds

You may cancel your subscription at any time through your App Store or Google Play account settings. Cancellation takes effect at the end of your current billing period, and you will retain access to subscription features until that time. We do not offer free trials. Refund requests must be submitted directly to Apple or Google according to their respective refund policies. We do not control or process refunds.

6.6 Subscription Changes

We reserve the right to modify subscription features, pricing, or terms at any time. Changes to pricing will not affect your current billing period but will apply to subsequent renewals. We will provide advance notice of significant changes through the Application or via email.

7. Privacy and Data Collection

Your use of the Application is subject to our Privacy Policy, available at https://mapplicant.com/privacy-policy. By using the Application, you consent to the collection, use, storage, and sharing of your information as described in the Privacy Policy. The Privacy Policy explains how we handle personal data in compliance with UK GDPR and the Data Protection Act 2018.

8. Third-Party Services and Content

The Application integrates with and displays content from third-party services:

• Job Listings: We display job postings from third-party job boards and aggregators. We are not responsible for the accuracy, completeness, or legitimacy of third-party job listings.
• Google Maps: The Application uses Google Maps API, which is subject to Google's Terms of Service.
• External Links: The Application may contain links to third-party websites or services. We are not responsible for the content, privacy policies, or practices of third parties.
• App Store Services: Subscription management and payments are handled by Apple App Store or Google Play Store and are subject to their terms of service.

Your interactions with third-party services are governed solely by their terms and policies. We make no warranties regarding third-party services and disclaim all liability for any issues arising from your use of third-party services.

9. Updates and Modifications

We may provide updates, patches, bug fixes, or new versions of the Application from time to time. These updates may be automatically downloaded and installed on your device. You agree that we may automatically update the Application, and this EULA will apply to all updates. We may add, modify, or remove features at our discretion. We are not obligated to provide updates or maintain any particular features.

10. Age Requirements

You must be at least 16 years of age to use the Application. By using the Application, you represent and warrant that you meet this age requirement. We do not knowingly collect information from or allow use by individuals under 16 years of age.

11. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• WARRANTIES OF NON-INFRINGEMENT
• WARRANTIES THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
• WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF JOB LISTINGS
• WARRANTIES THAT DEFECTS WILL BE CORRECTED
• WARRANTIES REGARDING THIRD-PARTY SERVICES OR CONTENT

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ZDTECH GROUP LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• COST OF SUBSTITUTE GOODS OR SERVICES
• BUSINESS INTERRUPTION OR LOST OPPORTUNITIES
• DAMAGES ARISING FROM USE OR INABILITY TO USE THE APPLICATION
• DAMAGES ARISING FROM JOB LISTINGS, EMPLOYER INTERACTIONS, OR EMPLOYMENT DECISIONS
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO YOUR DATA
• DAMAGES ARISING FROM THIRD-PARTY SERVICES OR CONTENT

WHETHER ARISING IN CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICATION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless ZDTech Group Ltd, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use or misuse of the Application
• Your violation of this EULA or our Terms & Conditions
• Your User Content or any content you submit
• Your violation of any third-party rights
• Your violation of any applicable laws or regulations

14. Termination

This EULA is effective until terminated. We may terminate or suspend your license and access to the Application immediately, without prior notice or liability, for any reason, including if you breach this EULA. Upon termination:

• You must cease all use of the Application
• Delete all copies of the Application from your devices
• Your license rights immediately terminate
• Provisions that should survive termination (including disclaimers, limitations of liability, and indemnification) will remain in effect

15. Export Compliance

You agree to comply with all applicable export and import control laws and regulations in your use of the Application. You shall not export, re-export, or transfer the Application to any prohibited country, entity, or person in violation of any applicable laws.

16. Governing Law and Jurisdiction

This EULA shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from this EULA or your use of the Application shall be subject to the exclusive jurisdiction of the courts of England and Wales.

17. Apple App Store Additional Terms

If you download the Application from the Apple App Store, the following additional terms apply:

• This EULA is between you and ZDTech Group Ltd only, not Apple. Apple is not responsible for the Application or its content.
• Your license to use the Application is limited to a non-transferable license to use the Application on any Apple-branded device you own or control, as permitted by the App Store Terms of Service.
• Apple has no obligation to provide maintenance or support services for the Application.
• Apple is not responsible for addressing any claims by you or third parties relating to the Application or your use of it.
• In the event of any third-party claim that the Application infringes intellectual property rights, ZDTech Group Ltd, not Apple, is responsible for investigation and resolution.
• Apple and its subsidiaries are third-party beneficiaries of this EULA and may enforce it against you.
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and you are not on any U.S. Government list of prohibited or restricted parties.

18. Google Play Store Additional Terms

If you download the Application from Google Play Store, you also agree to Google's Terms of Service for Google Play, available at https://play.google.com/intl/en_us/about/play-terms/. In the event of a conflict between this EULA and Google's Terms of Service, Google's terms shall control with respect to your use of Google Play.

19. Changes to This EULA

We reserve the right to modify this EULA at any time. We will notify you of any material changes by posting the new EULA in the Application and updating the "Last updated" date. For significant changes, we may also provide notice through the Application or via email. Your continued use of the Application after changes become effective constitutes your acceptance of the modified EULA.

20. Severability

If any provision of this EULA is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary so that this EULA will otherwise remain in full force and effect and enforceable.

21. Entire Agreement

This EULA, together with our Terms & Conditions and Privacy Policy, constitutes the entire agreement between you and ZDTech Group Ltd regarding the Application and supersedes all prior agreements, representations, and understandings regarding the same. In the event of any conflict between this EULA and our Terms & Conditions, the Terms & Conditions shall control.
